Not unexpectedly Affiliated Enterprises soon folded, and returned the circuit in May of 1939 to Golby (who seems to have carried on the business for a short time). The Civic remained empty until December when it was leased to J. Wilson and Perry, who re-equipped the venue in time for Xmas. Meanwhile, Affiliated commenced a court action in September 1939 charging libel against Camphin/Katoomba Theatres & the newspaper. In March 1940 a jury awarded £400 damages against the defendants, who then appealed. In May the verdict was confirmed, resulting in a further swathe of headlines critical of Camphin’s despicable behavior. Sadly, 26 year old Bob Gelston (who had gone on to manage Hoyts Enmore) did not share in the award payment - having died in a motor vehicle accident on 28th February, a few days before the court decision.
